SWEEPSTAKES DATES:
This sweepstakes (the “Sweepstakes”) is sponsored by Hawaiian Airlines, Inc. (“Hawaiian”) and Foodland Super Market, LTD (“Foodland,” and together with Hawaiian, the “Sponsor”) and begins on November 2, 2019 at 12:01:00 AM Hawaii Standard Time ("HST") and ends on November 2, 2019 at 11:59:59 PM HST unless earlier terminated or extended at the sole discretion of the Sponsor (the "Sweepstakes Period"). For purposes of this Sweepstakes, a "day" is defined as a 24-hour period, beginning at 12:00:00 AM HST and ending at 11:59:59 PM HST except for the first day of the Sweepstakes where a day is defined as beginning at 12:00:00 PM (Noon) HST and ending at 11:59:59 PM HST. The Sponsor's computer, or that of its designee, runs the official clock for the Sweepstakes and the Sponsor, in its sole discretion, will determine the time at which an entry is received.
ELIGIBILITY:
The Sweepstakes is open to legal residents of the State of Hawaii who are eighteen (18) years of age or older and a member of both the Hawaiian’s HawaiianMiles mileage program (the “HawaiianMiles Program”) and Foodland’s Maika’i program (the “Maika‘i Program”). You must also have “linked” your HawaiianMiles and Maika’i accounts at the time of entry ("Eligible Participant" and/or "Entrant"). If accounts are not linked, members may link the accounts by visiting https://www.hawaiianairlines.com/merchant-partners/foodland/earn-hawaiianmiles (you must first register your permanent 12-digit Maika‘i Card number with Hawaiian Airlines at HawaiianAirlines.com/Foodland). Sponsor and their respective parent companies, related subsidiaries and affiliated companies, prize suppliers, and advertising and promotion agencies and each of their respective agents, representatives, officers, directors, shareholders, and employees, and the members of their immediate families (including spouses, members of stepfamilies, and their respective spouses regardless of residence), and individuals living in the same households, whether related or not, of the above, are not eligible to enter or win a prize. Each Entrant by participating in the Sweepstakes agrees to be bound by these Official Rules and the Sponsor's decisions made it its sole discretion. The Sweepstakes is valid only in the State of Hawaii and is subject to all applicable federal, state, and local laws and regulations. Hawaii state law governs this Sweepstakes.
HOW TO ENTER:
To enter an Entrant must be a member of the HawaiianMiles Program and Maika’i Program, and have “linked” their accounts at time of entry and award. If you don't already have a HawaiianMiles Program account visit https://www.hawaiianairlines.com/hawaiianmiles to create one. By submitting your information and creating a HawaiianMiles account, you agree to the HawaiianMiles Program rules and conditions and privacy policy. If you are not a member of the Maika’i Program visit any Foodland or Sack N Save store and ask a cashier to apply. By submitting your information and creating a Maika’i account, you agree to the Maika’i Program rules and conditions and privacy policy. If you do not agree to such program rules and conditions and privacy policy, you cannot become a HawaiianMiles or Maika’i Program member, and you may not participate in this Sweepstakes.
There are several ways to enter during the Sweepstakes Period:
1 - Automatic Entry: Eligible Participants will automatically be entered in the Sweepstakes in one of two ways: (i) an Eligible Participant will be automatically entered in the Sweepstakes by redeeming a valid Maika’i My Rewards Certificate for HawaiianMiles (ii) an Eligible Participant will be automatically entered in the Sweepstakes upon purchasing a Hawaiian Airlines Gift Card at any Foodland or Sack N Save store during the Sweepstakes period in the State of Hawaii and providing a valid Maika‘i rewards number at the time of purchase. Sweepstakes prizes shall be awarded to the HawaiianMiles Program member whose name and HawaiianMiles Program account was linked to the Maika‘i account presented at the time of the My Rewards Certificate redemption or HawaiianMiles gift card purchase. Other restrictions and exclusions may apply. Maika’i My Rewards Certificate mileage redemptions and Hawaiian Airlines Gift Card purchases must be completed by 11:59:59 PM HST on November 2, 2019, in order to be eligible.
2 - Non-Purchase Entry: An Eligible Participant may receive a Sweepstakes entry by logging on www.hawaiianairlines.com/foodlandsweepstakes and following the on-screen entry instructions. Each entry must be manually key stroked. Non-Purchase Entries must be received by 11:59:59 PM HST on November 2, 2019.
Each Entrant shall be limited to one entry. Additional eligible redemptions, qualified purchases and/or additional non-purchase entries will not result in additional entries and will not increase your chances of winning. By entering the Sweepstakes, Entrant agrees to comply with these Official Rules. Each individual entry may be submitted only by a single Entrant. Entries that do not comply with these Official Rules, as determined in Sponsor’s sole discretion, will be disqualified from the Sweepstakes. Decisions of the Sponsor are final and binding.
RANDOM DRAWING:
On or about November 25th, 2019, a random drawing from among all eligible automatic and non-purchase entries received will be conducted by Hawaiian Airlines Inc. Decisions of the Sponsor will be final and binding on all matters relating to this Sweepstakes.
PRIZES:
One (1) Grand Prize HawaiianMiles Winner: Eighty-thousand HawaiianMiles. Total Approximate Retail Value ("ARV") of the HawaiianMiles Grand Prize: $2,370.40. Miles are based on a value of $.02963 per mile.
The prize restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the affidavit and release. Limit one (1) prize per person. In no event will more prizes be awarded than those listed in these Official Rules. Winners are responsible for the payment of all applicable taxes on the prizes. Prizes will be awarded within 8 – 10 weeks of being confirmed as a winner. All details of prizes not specified herein shall be determined solely by Sponsor. Except as provided herein, no cash or prize substitution is allowed except at the discretion of Sponsor, who reserves the right to substitute a prize with one of comparable or greater value. If a prize cannot be awarded due to circumstances beyond the reasonable control of Sponsor, a substitute prize of comparable or greater retail value may be awarded; provided, however, that if a prize is awarded but unclaimed or forfeited by the winner, the prize might not be re-awarded, in Sponsor's sole discretion. By accepting prize, prize winners acknowledge compliance with these Official Rules.
Miles accrued, awards, and benefits issued are subject to change and are subject to the rules of the HawaiianMiles program. Sponsor may change the HawaiianMiles Program at any time and without notice, which changes may include without limitation, changes to the rules, regulations, travel awards and special offers or a termination the HawaiianMiles Program. Sponsor and its subsidiaries, affiliates and agents are not responsible for any products or services of other participating companies and partners. Taxes and fees related to award travel are the responsibility of the member. Information in these Official Rules that relates to the HawaiianMiles Program does not purport to be complete or comprehensive and may not include all of the information that a member may believe is important, and is qualified in its entirety by reference to all of the information on the HawaiianAirlines.com website and found in the HawaiianMiles Program rules. ODDS:
Odds of winning a prize depend upon the total number of eligible entries received.
WINNER NOTIFICATION:
Each potential Grand Prize winner will be notified within three (3) business days or as soon as reasonably practicable of the drawing by email and/or by phone to the email address and/or phone number provided by the Entrant and will be required to execute and return an Affidavit of Eligibility and any releases as determined by Sponsor in its sole discretion (which releases may include at a minimum, a liability and publicity release); and an IRS Form W-9 (Request for Taxpayer Identification Number and Certification) that will be used only for the purpose of reporting the winner's prize earnings to the Internal Revenue Service, as required by law. Failure to return any documents requested within five (5) days following the date of issuance of the email notification or following the date of request may result in the prize being forfeited and awarded to an alternate potential winner. Any return of a prize notification as undeliverable or noncompliance with these Official Rules will result in such potential winner being disqualified. Sponsor shall have no further obligation to individual, and an alternate potential winner may be determined. Sponsor shall have no responsibility for illegible, inaccurate or other failures with regard to the email address provided by the Entrant. By entering the Sweepstakes, Entrants agree to the use by Sponsor and its designees of their names, and photographs/likenesses for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation except where prohibited by law. If a potential winner (i) cannot be contacted after a reasonable attempt has been made by Sponsor (as determined in Sponsor's sole discretion); (ii) refuses the prize; and/or (iii) the prize or prize notification is rejected or returned as undeliverable, such potential winner forfeits all rights to be deemed a winner in the Sweepstakes and to receive the prize, and that potential winner will be disqualified and an alternate potential winner may be selected through a random drawing by the Sponsor from the remaining eligible entries. Prizes must be accepted as awarded. Except where prohibited by law, the winner's entry and acceptance of the prize constitutes permission for the Sponsor to use the winner's name, photograph, likeness, statements, and biographical information without further compensation.
CONDITIONS OF ENTRY:
Use of any automated entry software is prohibited. Electronically reproduced, mechanically reproduced, illegible, incomplete or inaccurate entries are void. By participating, Entrants agree to comply with these Official Rules including all eligibility requirements. Sponsor reserves the right to conduct a background check of any and all records of potential winner, including, without limitation, civil and criminal court records and police reports, and entry in the Sweepstakes constitutes Entrant's permission for Sponsor to conduct such background check, provided that, to the extent additional authorization is necessary under law, potential winner shall authorize such check. Sponsor reserves the right (at its sole discretion) to disqualify potential winner based on the results of the background check or failure to properly authorize such check. In case of a dispute as to the owner of an online entry, online entry will be deemed to have been submitted by the authorized account holder from which the entry is made. Caution: Any attempt by an Entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to select an alternate winner in its sole discretion in the event a selected winner refuses to comply with the terms herein, refuses in good faith to cooperate with reasonable requests by Sponsor, or otherwise acts in bad faith and provides Sponsor with a reasonable basis for disqualifying such selected winner.
LIMITATION OF LIABILITY:
By participating in the Sweepstakes, Entrants agree to release, indemnify and hold harmless Sponsor, and each of their respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from the Sweepstakes or acceptance, possession, use, misuse or nonuse of the prize (including any travel or travel-related activity thereto) that may be awarded. This Sweepstakes and these Official Rules shall be interpreted in accordance with the laws of the State of Hawaii without regard to its principles of conflicts of law. Jurisdiction and venue shall be solely within the State of Hawaii. Sponsor shall not be responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes related materials; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries; or for electronic, computer, or telephonic malfunction or error, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, or process any transaction thereon. If in the Sponsor's opinion, for any reason this Sweepstakes is not capable of running as planned, or there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer viruses, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Sponsors reserve the right at its sole discretion to disqualify any individual (and void the individual’s entry and/or prevent the individual from future participation) who tampers with the entry process and/or who is acting in violation of these Official Rules, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and at Sponsor's discretion conduct the drawing to award the prize(s) using all eligible non-suspect transactions and entries received as of the termination date. As a condition of entering the Sweepstakes, Entrants agree that: a.) under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b.) all causes of action arising out of or connected with this Sweepstakes, or the prizes awarded, shall be resolved individually, without resort to any form of class action; and c.) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event shall Entrant be entitled to receive attorneys' fees or other legal costs. Sponsor reserves the right to modify prize award procedures at its sole discretion.
PRIVACY:
Information collected from Entrants will be used only for the purpose of operating the Sweepstakes consistent with the Official Rules, notifying potential winners and awarding prizes, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless Entrant has opted-in to receive additional information and promotional material from Sponsor or a third party. By participating in the Sweepstakes, Entrant hereby consents to such use of his or her information. Once the Sweepstakes, including any known or unknown extensions of the Sweepstakes, has ended, all information supplied by Entrants will be removed from the database. By entering this Sweepstakes, each Entrant consents to Sponsor’s use of his/her voice, image, or other attribute in connection with Sponsor’s publicizing of the Sweepstakes in the event such Entrant is selected as a prize winner.

The winners will be posted to www.hawaiianairlines.com/foodlandsweepstakes by 12/30/2019.
